Commercial Arbitration

Arbitration is a process whereby parties to a dispute can opt out of the court system and submit their case for decision by a neutral third party. The basis of this alternate dispute resolution process was established by the New York Convention in 1958. It provides a framework for the recognition and enforcement of foreign Arbitral Awards.

Today there are 138 countries who are signatories to the New York Convention. Countries (contracting states) will implement local laws (generally based on uniform laws) to administer arbitration within their judicial boundaries.

Some countries, like Australia, will also issue local national laws which closely align to the accepted approach of International Arbitration in order to onvoke a platform to resolve domestic disputes without needing to resort to the court system.
